Not illustrated. 1800 Excerpt: ...in that cafe, two concurrent contingencies, of which either is to start, according as it happens, being remainders contemporary and not expectant one after another. But then both would be contingent, as-well that to the children of M. as that to IV. L., which was a construction never made without absolute necessity. Here there was no such necessity, the words " in default thereof," taking in both contingencies, as well that of M.'& dying without children, as of her children dying without heirs; which last construction reduced the cafe to that of a devise to one and his heirs; and, in default of heirs, then to a person who was collateral heir of the first devisee.
